1. Who may agree to these terms

Betty & Emyak is made for children. A child cannot agree to these terms. By downloading, installing or allowing a child to use the app, **you confirm that you are the parent or legal guardian**, that you are old enough to enter a contract, and that you accept these terms on the child's behalf and supervise their use.

If you do not accept them, delete the app.

2. What the app is

An offline English-learning app for children: words, stories, grammar, speaking practice, quizzes and games. It runs entirely on the device.

It is a learning aid, not a teacher, examiner or certification. The app does not assess a child's abilities in any formal sense, and its scores, levels and "streaks" are motivational features, not educational measurements. It gives no diagnosis or advice of any kind about a child's development, hearing or speech.

3. Licence

You get a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your household's own non-commercial use.

You may not: copy, redistribute, sell, rent, sub-license or publish the app or any part of it; extract, reuse or republish its text, artwork, audio or data; reverse engineer it except where law expressly permits; use it in a school, nursery, course or any other commercial or institutional setting without our written permission; or remove any notice of ownership.

4. Ownership

The app, its name, its artwork, its written content, its recorded audio and its software are owned by Emrah Saygıner or its licensors, and are protected by copyright and other laws. These terms grant use, not ownership.

5. Microphone and speech practice

The speaking exercises need the device microphone. Granting or refusing that permission is your decision; refusing it leaves the rest of the app working. The app does not record or store audio, and it sends nothing to us. Speech-to-text is performed by the device's own speech recognition service, which is part of the operating system and outside our control — see the Privacy Policy.

6. Your child's data and your backup

We collect nothing, and this is a term of this agreement, not just a description. For the avoidance of doubt, we undertake that this app, as supplied:

kind, and specifically no Google Analytics, Firebase Analytics or comparable tool, no event logging, no session tracking, no crash or performance reporting;

progress (XP, day streak, words practised, stories read, games played); these are written to your device's storage only, are never sent anywhere, and we cannot see them. The shipped app makes no network request of any kind;

account, username, password, e-mail address or phone number. The "profiles" in the app are names stored on your device so siblings can keep separate progress; they are not accounts with us;

fingerprinting.

Consequently we are neither a data controller nor a data processor in respect of your or your child's data. If a future version changes any of this, these terms and the Privacy Policy will be updated before that version is released.

The app keeps progress on the device only and sends nothing to us. **We hold no copy and cannot restore anything.** If you want progress to survive a lost phone, a reinstall or a factory reset, use the export in the Parent area and keep that file yourself. Losing a device without an export means losing the progress on it, and we cannot help.

The hero name is typed freely by whoever sets up the profile. Please use a nickname. You are responsible for what is typed into it.

7. Purchases

The app currently offers no purchases and no purchase screen is reachable. If paid features are introduced, they will be sold through the app store, subject to the store's own terms and refund rules, and these terms will be updated first.

8. Children's safety features

The Parent area is behind a press-and-hold gate. It is a nuisance barrier for a young child, not a security control — it will not stop a determined or older child. Supervision remains yours.

9. Availability and changes

We may update the app to fix problems, add content or adapt to new operating system versions. We may change or discontinue features. We do not promise the app will always be available, or that it will keep working on future operating system versions or on devices we have not tested.

10. No warranty

The app is provided "as is" and "as available", without warranties of any kind beyond those that law gives you and that cannot be excluded. We do not warrant that it is error-free, that its content is free of mistakes, or that it will meet any particular educational goal.

Nothing here limits rights you have as a consumer under the mandatory law of your country of residence.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, for loss of progress or data (see clause 6), or for loss arising from use of the app contrary to these terms. Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

12. Ending the agreement

You may end it at any time by deleting the app. We may end it if you breach these terms. On ending, the licence in clause 3 stops; data already on your device is unaffected until you delete it.

13. Changes to these terms

If these terms change, the updated version will be published at https://bettyemyak.com/terms.html with a new effective date, and the change will take effect for you the next time you update or continue using the app. If a change materially reduces your rights, continuing to use the app after it takes effect is what constitutes acceptance; if you do not accept it, delete the app.

14. Third-party services

The app uses no third-party services at run time — no accounts, no cloud, no analytics, no advertising. The only third parties involved are the app store you downloaded from and, for the speaking exercises, your device's own speech recognition service, which belongs to your device's operating system. Each is governed by its own terms, not ours.

15. The rest of the small print

16. Governing law and disputes

These terms are governed by the laws of Türkiye, and disputes will be heard by the courts of İstanbul, Türkiye, without depriving a consumer of the protection of the mandatory law of their own country of residence.

1. Bu koşulları kim kabul edebilir

Betty & Emyak çocuklar için yapılmıştır. Bir çocuk bu koşulları kabul edemez. Uygulamayı indirerek, kurarak veya bir çocuğun kullanmasına izin vererek ebeveyn ya da yasal vasi olduğunuzu, sözleşme kurmaya ehil olduğunuzu, bu koşulları çocuk adına kabul ettiğinizi ve kullanımı gözetleyeceğinizi beyan edersiniz.

Kabul etmiyorsanız uygulamayı silin.

2. Uygulama nedir

Çocuklar için çevrimdışı çalışan bir İngilizce öğrenme uygulaması: kelimeler, hikâyeler, gramer, konuşma alıştırması, sınavlar ve oyunlar. Tümüyle cihaz üzerinde çalışır.

Bu bir **öğrenme yardımcısıdır; öğretmen, sınav görevlisi veya sertifika değildir.** Uygulama çocuğun yeteneklerini resmî anlamda ölçmez; puanlar, seviyeler ve "seriler" motivasyon amaçlı özelliklerdir, eğitim ölçümü değildir. Çocuğun gelişimi, duyması veya konuşması hakkında hiçbir teşhis veya tavsiye vermez.

3. Lisans

Uygulamayı, sahibi veya kontrol sahibi olduğunuz cihazlarda, hanenizin kendi ticari olmayan kullanımı için kullanmanıza yönelik kişisel, münhasır olmayan, devredilemez ve geri alınabilir bir lisans verilir.

Şunları yapamazsınız: uygulamayı veya bir parçasını kopyalamak, yeniden dağıtmak, satmak, kiralamak, alt lisanslamak veya yayınlamak; metnini, görsellerini, sesini veya verisini çıkarmak, yeniden kullanmak veya yeniden yayınlamak; kanunun açıkça izin verdiği hâller dışında tersine mühendislik yapmak; yazılı iznimiz olmadan okul, kreş, kurs veya başka ticari ya da kurumsal bir ortamda kullanmak; mülkiyet bildirimlerini kaldırmak.

4. Mülkiyet

Uygulama, adı, görselleri, yazılı içeriği, kayıtlı sesleri ve yazılımı Emrah Saygıner veya lisans verenlerine aittir; telif hakkı ve diğer kanunlarla korunur. Bu koşullar kullanım hakkı verir, mülkiyet vermez.

5. Mikrofon ve konuşma alıştırması

Konuşma alıştırmaları cihaz mikrofonuna ihtiyaç duyar. Bu izni vermek veya vermemek sizin kararınızdır; vermemek uygulamanın geri kalanını çalışır durumda bırakır. Uygulama ses kaydı yapmaz veya saklamaz ve bize hiçbir şey göndermez. Sesin yazıya çevrilmesini, işletim sisteminin parçası olan ve kontrolümüz dışında bulunan cihazın kendi konuşma tanıma servisi yapar — bkz. Gizlilik Politikası.

6. Çocuğunuzun verisi ve yedeğiniz

**Hiçbir veri toplamıyoruz ve bu, yalnızca bir açıklama değil, bu sözleşmenin bir hükmüdür.** Tereddüde yer bırakmamak adına, sunulduğu hâliyle bu uygulamanın:

hizmeti, özellikle Google Analytics, Firebase Analytics veya benzeri bir araç kullanılmadığını, olay kaydı, oturum takibi, çökme veya performans raporlaması yapılmadığını;

için sayaç tutar (XP, gün serisi, çalışılan kelime, okunan hikâye, oynanan oyun); bunlar yalnızca cihazınızın belleğine yazılır, hiçbir yere gönderilmez ve bizim görmemiz mümkün değildir. Yayınlanan uygulama hiçbir ağ isteği yapmaz;

kullanıcı adı, şifre, e-posta veya telefon numarası bulunmadığını. Uygulamadaki "profiller", kardeşlerin ilerlemesi ayrı tutulabilsin diye cihazınızda saklanan adlardır; bizde açılmış hesaplar değildir;

çerez veya parmak izi bulunmadığını

taahhüt ederiz.

Bunun sonucu olarak, sizin veya çocuğunuzun verisi bakımından **veri sorumlusu da veri işleyen de değiliz.** İleride bir sürüm bunlardan herhangi birini değiştirirse, bu koşullar ve Gizlilik Politikası o sürüm yayınlanmadan önce güncellenecektir.

Uygulama ilerlemeyi yalnızca cihazda tutar ve bize hiçbir şey göndermez. Elimizde hiçbir kopya yoktur ve hiçbir şeyi geri getiremeyiz. İlerlemenin kaybolan bir telefondan, yeniden kurulumdan veya fabrika ayarlarına dönüşten sağ çıkmasını istiyorsanız, Ebeveyn bölümündeki dışa aktarmayı kullanın ve o dosyayı kendiniz saklayın. Dışa aktarma olmadan cihazın kaybı, üzerindeki ilerlemenin de kaybı anlamına gelir ve bu konuda yardımcı olamayız.

Kahraman adı, profili kuran kişi tarafından serbestçe yazılır. Lütfen takma ad kullanın. Buraya yazılanın sorumluluğu size aittir.

7. Satın almalar

Uygulamada şu anda satın alma yoktur ve satın alma ekranına erişilemez. Ücretli özellikler eklenirse, uygulama mağazası üzerinden, mağazanın kendi koşulları ve iade kurallarına tabi olarak satılacak; bu koşullar önceden güncellenecektir.

8. Çocuk güvenliği özellikleri

Ebeveyn bölümü basılı tutma kapısının arkasındadır. Bu, küçük bir çocuk için caydırıcı bir engeldir; bir güvenlik denetimi değildir — kararlı ya da daha büyük bir çocuğu durdurmaz. Gözetim sizde kalır.

9. Erişilebilirlik ve değişiklikler

Sorunları gidermek, içerik eklemek veya yeni işletim sistemi sürümlerine uyum sağlamak için uygulamayı güncelleyebiliriz. Özellikleri değiştirebilir veya sonlandırabiliriz. Uygulamanın her zaman erişilebilir olacağını ya da gelecekteki işletim sistemi sürümlerinde veya test etmediğimiz cihazlarda çalışmayı sürdüreceğini taahhüt etmiyoruz.

10. Garanti verilmemesi

Uygulama, kanunun size tanıdığı ve hariç tutulamayan haklar dışında hiçbir garanti olmaksızın "olduğu gibi" ve "mevcut hâliyle" sunulur. Hatasız olduğunu, içeriğinde yanlışlık bulunmadığını veya belirli bir eğitim hedefini karşılayacağını garanti etmiyoruz.

Buradaki hiçbir hüküm, ikamet ettiğiniz ülkenin emredici hukuku uyarınca tüketici olarak sahip olduğunuz hakları sınırlamaz.

11. Sorumluluğun sınırlandırılması

Kanunun izin verdiği ölçüde; dolaylı veya sonuç olarak doğan zararlardan, ilerleme ya da veri kaybından (bkz. madde 6) ve uygulamanın bu koşullara aykırı kullanımından doğan zararlardan sorumlu değiliz. Buradaki hiçbir hüküm, ihmalden kaynaklanan ölüm veya kişisel yaralanma, hile ya da hukuken hariç tutulamayan diğer hâllere ilişkin sorumluluğu ortadan kaldırmaz.

12. Sözleşmenin sona ermesi

Uygulamayı silerek her an sona erdirebilirsiniz. Bu koşulları ihlal etmeniz hâlinde biz sona erdirebiliriz. Sona erdiğinde madde 3'teki lisans durur; cihazınızda bulunan veriler, siz silmedikçe etkilenmez.

13. Bu koşullardaki değişiklikler

Bu koşullar değişirse, güncel sürüm yeni bir yürürlük tarihiyle şu adreste yayınlanır: https://bettyemyak.com/terms.html. Değişiklik, uygulamayı bir sonraki güncellemenizde veya kullanmaya devam ettiğinizde sizin için yürürlüğe girer. Değişiklik haklarınızı esaslı biçimde azaltıyorsa, yürürlüğe girdikten sonra kullanmaya devam etmek kabul anlamına gelir; kabul etmiyorsanız uygulamayı silin.

14. Üçüncü taraf hizmetleri

Uygulama çalışma zamanında hiçbir üçüncü taraf hizmeti kullanmaz — hesap yok, bulut yok, analitik yok, reklam yok. İşin içindeki tek üçüncü taraflar, indirdiğiniz uygulama mağazası ve konuşma alıştırmaları için cihazınızın işletim sistemine ait olan kendi konuşma tanıma servisidir. Her biri bizim değil kendi koşullarına tabidir.

15. Kalan hükümler

yürürlükte kalır ve geçersiz hüküm kanunun izin verdiği ölçüde daraltılmış sayılır.

aramızdaki sözleşmenin tamamıdır; mağaza sayfaları ve tanıtım metinleri dâhil başka yerlerde söylenenlerin yerine geçer.

16. Uygulanacak hukuk ve uyuşmazlıklar

Bu koşullar Türkiye hukukuna tabidir ve uyuşmazlıklar İstanbul, Türkiye mahkemelerinde görülür; bu, tüketicinin kendi ikamet ülkesinin emredici hukukunun sağladığı korumadan yoksun bırakılması anlamına gelmez.
